Terms of Use

1. Acceptance of Terms

By downloading, installing, or using the Chat Keñes mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not download or use the App.

These Terms constitute a legally binding agreement between you and the operator of Chat Keñes (available at qaratasai.kz, referred to as "we", "us", or "our").

2. Description of Service

Chat Keñes is an AI-powered chat application that enables users to have text and image-based conversations with an artificial intelligence system, with full support for the Kazakh and Russian languages.

Important: AI-generated responses may be inaccurate, incomplete, or outdated. Chat Keñes does not provide medical, legal, financial, psychological, or any other professional advice. Do not rely on AI-generated content for decisions that require professional judgement. Always consult a qualified professional for such matters.

3. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent and warrant that you are at least 13 years of age. If you are under the age of majority in your jurisdiction, you must have obtained the consent of a parent or legal guardian before using the App.

We reserve the right to terminate accounts if we discover that a user does not meet the eligibility requirements.

4. Account Registration

You must provide an accurate, current phone number during registration. Your phone number is used to verify your identity via one-time password (OTP).
You are solely responsible for maintaining the confidentiality and security of your account. Do not share your OTP codes or allow others to access your account.
You are responsible for all activity that occurs under your account, whether or not authorised by you.
If you suspect unauthorised access to your account, notify us immediately at hello@qaratasai.kz.
You may only maintain one account. Creating multiple accounts to circumvent restrictions or subscription limits is prohibited.

5. Acceptable Use

You agree to use the App only for lawful purposes and in a manner consistent with these Terms and all applicable laws. You agree not to:

Generate, transmit, publish, or promote content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, hateful, or otherwise objectionable.
Use the App to produce content that sexualises minors in any way, or that facilitates exploitation or harm of any person.
Attempt to circumvent, bypass, or manipulate access controls, rate limits, content filters, or subscription restrictions built into the App.
Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code or underlying algorithms of the App or its AI components, except to the extent that such activity is expressly permitted by applicable law and cannot be contractually restricted.
Use automated scripts, bots, crawlers, or other automated means to access or interact with the App without our prior written permission.
Transmit malware, viruses, or any code of a destructive nature.
Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity.
Use the App in any manner that could disable, overburden, damage, or impair the servers or networks connected to the App.
Attempt to gain unauthorised access to any systems, networks, or data related to the App.

We reserve the right to determine, at our sole discretion, what constitutes a violation of this section and to take appropriate action, including immediate account suspension or termination.

6. Intellectual Property

The App and all of its components — including its name, logo, design, interface, codebase, and non-user-generated content — are owned by or licensed to qaratasai.kz and are protected by applicable intellectual property laws.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on a device you own or control, solely for your personal, non-commercial purposes.

You retain ownership of the content you submit to the App (your messages and images). By submitting content, you grant us a limited, worldwide, royalty-free licence to store, process, and transmit that content solely as necessary to provide the service to you. We do not claim broader ownership over your content.

7. Subscriptions and Billing

The App may offer free and paid subscription tiers. Paid subscriptions provide access to additional features or higher usage limits.

Payment. Subscriptions are purchased through and billed by Apple App Store (for iOS) or Google Play (for Android). Your subscription fee is charged to the payment method associated with your App Store or Google Play account at confirmation of purchase.
Auto-renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the renewal date.
Cancellation. You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time within a billing period.
Refunds. Refunds for App Store purchases are subject to Apple's refund policies. Refunds for Google Play purchases are subject to Google's refund policies. We do not directly process refunds for purchases made through these platforms.
Free tier. Features available without a subscription may be changed or limited at any time at our discretion.

8. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE AVAILABLE AT ALL TIMES, UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY AI-GENERATED CONTENT DELIVERED THROUGH THE APP.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, QARATASAI.KZ AND ITS TEAM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE APP EXCEED THE GREATER OF: (A) THE TOTAL AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE CLAIM; OR (B) ONE HUNDRED US DOLLARS (USD 100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the above limitations apply only to the extent permitted by applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless qaratasai.kz and its team from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

your use of the App in breach of these Terms;
your violation of any applicable law or regulation; or
your infringement of any third-party rights, including intellectual property rights.

We reserve the right, at your expense, to assume control of the defence of any matter subject to indemnification by you. You agree to cooperate reasonably with our defence of such claims.

11. Termination

We reserve the right to suspend or permanently terminate your access to the App at any time and without prior notice if we reasonably believe that you have violated these Terms, applicable law, or for any other legitimate business reason.

You may stop using the App at any time. If you wish to delete your account, please contact us at hello@qaratasai.kz.

Upon termination for any reason, the following sections of these Terms survive and remain in effect: Section 6 (Intellectual Property), Section 8 (Disclaimer of Warranties), Section 9 (Limitation of Liability), Section 10 (Indemnification), Section 12 (Governing Law), Section 13 (Dispute Resolution), and any other provisions that by their nature should survive termination.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law principles.

13. Dispute Resolution

Any dispute, claim, or controversy arising out of or in connection with these Terms, or the use of the App, shall be submitted to and resolved by the competent courts of the Republic of Kazakhstan. You and we each consent to the personal jurisdiction of such courts for the purpose of resolving any such dispute.

14. Changes to These Terms

We may update these Terms from time to time to reflect changes in the App, applicable law, or our business practices. When we make material changes, we will notify you through the App or by posting the updated Terms with a new "Last updated" date. Your continued use of the App after we post any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App.
